Product Purchase Agreement and EULA
Effective Date: October 1, 2025.
Applies to: CDX Vehicle Communication Interface and all associated hardware, accessories, firmware, and software distributed by Crash Pulse CDX LLC, Crash Pulse Technologies LLC, or any other LLC owned by the Crash Pulse brand (“Crash Pulse,” “we,” “us,” or “our”).
1. Acceptance of Agreement
By purchasing, accepting delivery of, installing, or using the CDX product or any related hardware, firmware, or accessories (collectively, the “Product”), the purchaser and/or end user (“User,” “You,” or “Customer”) acknowledges that they have read, understood, and agree to be legally bound by the terms and conditions set forth in this Product Use & Purchase Agreement / End-User License Agreement (“Agreement”).
If You do not agree to these terms, do not purchase, install, or use the Product. Use of the Product constitutes acceptance of this Agreement.
2. Intended Use and Professional Limitation
The Product is expressly designed and intended solely for use by qualified forensic engineers, accident reconstructionists, or similarly trained professionals for lawful vehicle crash data analysis.
The Product is not intended for consumer diagnostic, performance tuning, vehicle modification, or general automotive service use. Any use outside the stated forensic or investigative purpose constitutes unauthorized use.
Crash Pulse disclaims all responsibility for results, interpretations, or outcomes derived from the use of the Product, including but not limited to investigative conclusions, expert testimony, or litigation outcomes. The User is solely responsible for independent verification and professional interpretation of any data obtained.
3. Ownership and License Grant
The hardware component of the Product is sold, not licensed. However, any firmware, microcode, embedded software, scripts, configuration data, and accompanying documentation (collectively, “Software”) are licensed, not sold.
Crash Pulse retains all intellectual property rights in and to the Software and any related technology, trade secrets, and documentation.
Crash Pulse grants You a limited, non-exclusive, non-transferable, non-sublicensable license to use the Software solely in connection with the operation of the original Product as shipped.
You shall not:
- Copy, modify, disassemble, decompile, reverse engineer, or derive source code from the Software;
- Attempt to bypass firmware protections or security mechanisms;
- Use the Software in any manner that infringes third-party intellectual property or violates applicable law.
Any unauthorized modification or duplication constitutes a material breach of this Agreement and may result in immediate termination of the license, voiding of warranty, and legal action.
4. Data Access, Compatibility, and Updates
Crash Pulse makes no representation or warranty that the Product or Software will maintain compatibility with third-party software, vehicle networks, OEM systems, or external forensic platforms.
Use Requirement: Operation of the CDX Vehicle Communication Interface requires an active and valid Bosch Crash Data Retrieval (CDR) software license, version 25.0.817 or earlier. The Product is not designed for, or warranted to function with, unlicensed, expired, or future versions of Bosch CDR software beyond 25.0.817. It is the User’s responsibility to maintain a compliant and active Bosch CDR license for lawful use.
Crash Pulse reserves the right to update, modify, or discontinue Software or firmware at its sole discretion and without prior notice.
5. Product Handling, Tampering, and Repairs
Altering PCB components, or using unapproved accessories, cables, or adapters constitutes tampering and can void all applicable warranties. Reverse engineering of the Products hardware, firmware, and software are strictly prohibited.
Crash Pulse assumes no responsibility for damages or malfunctions arising from improper storage, misuse, modification, or reverse engineering efforts.
6. Limitation of Liability
To the fullest extent permitted by law, Crash Pulse Technologies LLC, its affiliates, officers, employees, contractors, and agents shall not be liable for any indirect, incidental, consequential, punitive, exemplary, or special damages, including but not limited to loss of data, profits, revenue, or goodwill, arising out of or in connection with the purchase, use, or inability to use the Product.
In no event shall Crash Pulse’s total liability exceed the amount actually paid by the Customer for the specific Product giving rise to the claim.
The limitations set forth herein apply regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise, and shall survive failure of any exclusive remedy.
7. Indemnification
You agree to indemnify, defend, and hold harmless Crash Pulse Technologies LLC and its affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your misuse or unauthorized use of the Product;
- Any violation of this Agreement;
- Any breach of applicable law or third-party rights in connection with the Product’s use or data output.
- Any improper, incomplete, inaccurate, or failed retrieval, decoding, or interpretation of data, including instances where data may exist but is not successfully captured, displayed, or interpreted by the Product.
7A. Data Accuracy and Retrieval Disclaimer
Crash Pulse makes no guarantee that data will be available, accessible, readable, or accurate for any specific vehicle, module, or crash event. Data retrieved through the Product may be incomplete, corrupted, misinterpreted, or absent even when data is present in the vehicle system or module. The User acknowledges that vehicle data integrity depends on numerous external factors, including but not limited to OEM protocols, hardware damage, encryption, and environmental conditions. The User assumes all responsibility for verifying the accuracy, completeness, and suitability of any data retrieved or interpreted through the Product.
8. Export Control and Regulatory Compliance
The Product may be subject to U.S. export control laws and international trade regulations. You agree not to export, re-export, transfer, or use the Product in violation of any applicable export control statute or regulation.
You further agree that the Product will not be used in or transferred to any country or entity subject to U.S. sanctions or embargoes.
9. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of laws principles.
Any dispute, controversy, or claim arising under or related to this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida, USA, and You hereby irrevocably consent to such jurisdiction and venue.
10. Severability
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.
11. Entire Agreement
This Agreement constitutes the entire understanding between the parties with respect to the Product and supersedes all prior communications, representations, or agreements, whether oral or written.
Crash Pulse reserves the right to amend or update this Agreement from time to time, with such modifications effective upon posting to the official website. Continued use of the Product after such posting constitutes acceptance of the revised Agreement.
12. Right to Refuse or Cancel Orders
Crash Pulse Technologies reserves the unconditional right, in its sole discretion, to refuse, cancel, or limit any order at any time and for any reason, including but not limited to suspected fraud, misuse, violation of this Agreement, unavailability of product, export restrictions, or errors in pricing or product information.
If an order is cancelled after payment has been processed, Crash Pulse will issue a full refund of the amount paid. Crash Pulse shall have no further liability or obligation to the Customer beyond such refund.
